Terms & Conditions
Effective 23 September 2026 · Last updated 4 October 2026
These Terms & Conditions (“Terms”) govern your use of onceuponyou.store (the “Site”) and any purchase of personalized books and related products and services (the “Service”) from Digity C LLC, a Delaware limited liability company trading as OnceUponYou (“we,” “us,” or “our”).
By using the Site or placing an order, you agree to these Terms, our Privacy Policy, our Children’s Privacy & Photo Policy, and our Returns & Refunds Policy. If you do not agree, please do not use the Site.
Please read section 15 carefully. It requires most disputes to be resolved through individual binding arbitration and waives your right to take part in a class action. You may opt out within 30 days - see section 15.7.
1. Who can use the Service
- You must be at least 18 years old and able to form a binding contract to place an order.
- The Service is designed for parents, legal guardians and other adults creating books for children. It is not directed at children, and children may not use the Site or submit information to us.
- By uploading a child’s photo or details, you confirm that you are that child’s parent or legal guardian, or that you have the express permission of the child’s parent or legal guardian.
2. How the Service works
OnceUponYou creates personalized storybooks using artificial intelligence (“AI”). You provide details such as a child’s name, age, interests and photos (“Your Content”). We use AI systems to generate a story and illustrations from Your Content (the “Book”). The Book is delivered as a digital file, a printed book, or both, depending on what you order.
Your Book is generated after payment and takes a little time to produce. We email you when it is ready. Before a printed Book goes to production you can preview it and request changes, as described in section 5.
3. AI-generated content: what to expect
- Likeness is an interpretation, not a photograph. Illustrations are artistic interpretations generated by AI. They are inspired by the photos you provide, but characters will not be exact likenesses and may vary in appearance between pages.
- Occasional imperfections. AI-generated images can contain artistic inconsistencies - small details, hands, backgrounds. The preview and revision process exists so you can catch these before printing.
- Story content. Stories are generated by AI within guidelines designed to keep them age-appropriate. Please read your preview in full before approving it. You are responsible for approving content you are comfortable sharing with your child.
- Screen versus print. Printed colors may differ slightly from what you see on screen. This is normal and is not a defect.
4. Your Content
Your responsibilities. You may only submit content you have the right to share. You agree not to upload:
- photos of any child for whom you are not the parent or legal guardian, unless you have that parent’s or guardian’s permission;
- photos of any adult without their permission;
- nudity, sexual, violent, hateful or unlawful content; or
- content that infringes anyone’s intellectual property, privacy or publicity rights.
License to us. You keep ownership of Your Content. You grant us a limited, non-exclusive, worldwide, royalty-free license to use, store, process and reproduce Your Content solely to create, deliver, support and print your Book and to operate the Service. This includes sharing it with the service providers who help us do so. This license ends when Your Content is deleted under our Children’s Privacy & Photo Policy.
We do not use your child’s photos or information to train AI models, and we do not use them in marketing, without your separate, explicit consent.
Our right to refuse. We may decline or cancel any order we reasonably believe violates this section, with a full refund.
5. Preview, revisions and approval
After your Book is generated we email you a link to preview it. What you can change, and how long you have, depends on what you ordered.
- Text edits are unlimited while your window is open.
- Illustration regeneration is limited. You may regenerate up to 3 pages, with up to 2 attempts on each of those pages.
- Printed books: your editing window is 48 hours from the moment we send your preview.
- Printed books are approved automatically when the editing window closes. If you have not approved your Book by the end of the 48 hours, it is approved automatically and sent to print with the version of every page selected at that moment. We email you a reminder when 24 hours are left and again when 8 hours are left. You can approve it sooner yourself, and it then goes to print right away.
- Digital books: you have 30 days from delivery to request changes.
- Printed copy of a digital Book. If you order a printed copy of a digital Book you already have, your digital Book is your preview. We print its story and pictures as they are when you order, and add a back cover. Placing the order counts as approving it for print.
- Once a Book is approved - by you or automatically - it goes into production and cannot be changed or cancelled.
You are responsible for reviewing names, spelling, dedication text and all content before approval. We are not responsible for errors in content you approved.
6. Orders, pricing and payment
- All prices are shown in U.S. dollars. Prices and promotions may change at any time, but changes will not affect orders you have already paid for.
- Payment is processed securely by Stripe. We never receive or store your full card details.
- Placing an order is an offer to buy. We accept it when we confirm your order by email. We may refuse or cancel an order - for example because of a pricing error, suspected fraud, or a violation of these Terms - and will refund any amount charged.
- Prices shown are the amount you pay. Where any tax applies to your purchase, it is included in that amount unless we state otherwise at checkout.
Charges appear on your statement as ONCEUPONYOU.
7. Promotions and discount codes
Discount codes and promotions are subject to their stated terms. Unless stated otherwise they cannot be combined, have no cash value, are not transferable, and may be withdrawn at any time. We may cancel orders that use codes obtained or used fraudulently or in breach of their terms.
8. Shipping (printed books)
- We currently ship printed Books only to addresses in the United States. Checkout will not accept a shipping address in any other country.
- Printed Books are produced and shipped by our printing partner. Estimated production and delivery times are estimates, not guarantees.
- Title and risk of loss pass to you when the Book is delivered to the carrier.
- Please make sure your shipping address is correct. Books returned or lost because of an incorrect address you provided are not eligible for a free reprint - see our Returns & Refunds Policy.
9. Digital books
Digital Books are licensed, not sold. We grant you a personal, non-exclusive, non-transferable license to download, view and print your digital Book for personal, non-commercial use, including sharing it with family and friends. You may not resell it or use it commercially.
10. Returns and refunds
Because every Book is custom-made for one child, it cannot be resold, and our refund options are limited. See our Returns & Refunds Policy for full details. It forms part of these Terms.
11. Intellectual property
- The Site, our software, story structures, designs, branding and everything we provide (other than Your Content) are owned by us or our licensors and are protected by law.
- You may use your Book as described in section 9. For printed Books, you own the physical copy.
- Because Books are generated with AI, some elements may not qualify for copyright protection. We do not guarantee that you will have exclusive rights to any illustration or story element, and similar elements may appear in other customers’ books.
12. Acceptable use
You agree not to:
- misuse the Site, interfere with its operation, or try to access it through unauthorized means;
- scrape, copy or reverse engineer the Site or its outputs at scale;
- use the Service to create content that is harmful, deceptive or unlawful, or that depicts a real person without their permission; or
- resell the Service or Books without our written permission.
13. Disclaimers
To the maximum extent permitted by law, the Service and Books are provided “as is” and “as available.”We disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, except as expressly stated in these Terms and our Returns & Refunds Policy. We do not guarantee that the Site will be uninterrupted or error-free, or that AI output will meet every expectation.
Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
14. Limitation of liability
To the maximum extent permitted by law:
- we are not liable for any indirect, incidental, special, consequential or punitive damages; and
- our total liability for any claim relating to the Service or a Book is limited to the amount you paid for the order that gave rise to the claim.
Some states do not allow certain limitations, so some of the above may not apply to you.
15. Dispute resolution and binding arbitration
15.1 Talk to us first. Most concerns are resolved quickly. Before starting any formal claim, email us at support@onceuponyou.store with your name, order number, a description of the issue and the resolution you want. We both agree to try in good faith to resolve it informally for 60 days.
15.2 Agreement to arbitrate. If we cannot resolve it, you and we agree that any dispute arising from or relating to these Terms, the Site or any Book will be resolved through final and binding individual arbitration, not in court. The exceptions are in section 15.4.
15.3 Rules and location. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. It will take place in the county where you live or, if both parties agree, by video or written submissions. For claims under $10,000 we will reimburse your filing fees unless the arbitrator finds your claim frivolous.
15.4 Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may seek court relief for infringement or misuse of intellectual property.
15.5 Class action waiver. You and we may bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective or representative proceeding. The arbitrator may not combine the claims of more than one person or award relief to anyone other than the individual party.
15.6 Mass filings. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or organization, they will be administered in batches under the arbitration provider’s mass-arbitration procedures.
15.7 Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@onceuponyou.store with your name, email address and a clear statement that you opt out of arbitration. Opting out will not affect anything else in your relationship with us.
15.8 Severability. If the class action waiver is found unenforceable for any claim, that claim must be decided in court, not arbitration, and all other claims stay in arbitration.
16. Governing law
These Terms are governed by the laws of the State of Delaware and the Federal Arbitration Act, without regard to conflict-of-law rules. Subject to section 15, any court proceedings will take place in the state or federal courts located in Delaware.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for material changes, notify you by email or on the Site. The Terms in effect when you placed an order apply to that order.
18. General
- These Terms, together with the policies linked above, are the entire agreement between you and us about the Service.
- If any provision is found unenforceable, the rest remains in effect.
- Our failure to enforce a provision is not a waiver of it.
- You may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition or sale of assets.
- We are not responsible for delays caused by events beyond our reasonable control, such as carrier disruptions, natural disasters or service provider outages.
